Terms of Use

To ensure service quality and customer privacy and to guarantee the integrity, security, reliability and privacy of Jifeng products, systems, networks, services, server hosting implementations and the materials contained therein (collectively referred to as "Jifeng Network Services"), this Acceptable Use Policy (AUP) defines acceptable use of the services. Jifeng customers (for the purpose of this policy, defined as any party purchasing services from Jifeng) need to comply with the AUP as a term of accepting Jifeng Network Services. Jifeng customers are entirely responsible for the content, interface protocols and services of Jifeng Network Services that they access, publish, post or otherwise use.

A. Prohibited Activities

It is a violation of Jifeng policy for any customer or other service user to carry out or participate in any of the activities described below through a service (whether such activities are actual or attempted, whether directly or indirectly).

Any of the actions listed below (each, a "Prohibited Activity") constitutes an abuse of Jifeng Network Services and interference with other customers. These actions are strictly prohibited:

1) Advertising, transmitting or otherwise obtaining any software, program, product or service that violates the AUP, including but not limited to engaging in or promoting tools used to send unauthorized commercial information or any form of communication or unauthorized bulk mail ("SPAM"), running Ping commands, flood attacks and denial of service attacks, etc.;

2) Forging users or other service tools, which are provided to Jifeng or other service users or used to engage in activities or behaviors aimed at retaining or concealing the identity of customer service or terminal users or contacting any activities or behaviors, including but not limited to intentionally leaking, deleting, counterfeiting or misrepresenting important information, such as: customer business information, order information, product information, operating data, etc.;

3) Engaging in any other activities that:

- Violate laws or regulations, including but not limited to leaking user data, invading user privacy, selling important business data, pornography-related products, stealing copyrights, counterfeit goods, registered trademarks, patents, trade secrets or other intellectual property rights;

- Violate Jifeng's exclusive rights under the relevant franchise agreement;

- Threaten any the integrity or security of a network or computer system, including but not limited to the transmission of viruses, Trojan horses, worms, mail bombs, keystroke loggers, spyware, adware or any harmful programs or similar computer code designed to negatively affect the operation of computer software or hardware;

- with the intent to harm or attempt to harm minors in any way;

- attempt to use the Service in a way that evades taxes or other requirements for payment of fees for use;

- otherwise degrade or interfere with other users' use of a Service;

- breach any legal obligations owed to third parties, such as contractual obligations or obligations to be performed;

- violate generally accepted standards of conduct and use of international or other networks, including but not limited to modification of web pages, network scanning and unauthorized system penetration.

4) engage in any of the above activities by using the services of other providers, except for directing activities through a Service through a Jifeng account, mail proxy or other means. Any indirect violation or attempted violation of this AUP by or on behalf of any customer or customer's end user, as well as any actual violation or attempted violation of this AUP by any third party on behalf of any customer or customer's end user, will be deemed a violation of this AUP by such customer or customer's end user.

B. Rights and Remedies

If Jifeng determines that any customer, its representatives or end-user has violated or failed to comply with this AUP or has engaged in (or permitted others to engage in) any prohibited activity, Jifeng may take such action as it deems appropriate. This may include all or any of the following:

1) suspending and/or terminating the customer's service at any time;

2) issuing a warning to the customer;

3) initiating legal proceedings against the customer for all costs (including, but not limited to, reasonable administrative and legal fees) incurred as a result of the violation of this AUP on an indemnity basis;

4) denying all communications from known IP locations that support illegal activity in order to protect the customer's systems and network resources;

5) taking further legal action against the customer; and

6) investigating and notifying the relevant judicial authorities if the conduct is illegal.

If Jifeng receives a court order requiring it to reveal the identity of a customer to a person who accuses the customer of abusing the service, Jifeng has the right to do so. Jifeng also has the right to disclose the identity of a customer or other information in Jifeng's possession about the use of the service to the police or other public authorities if the law requires it to do so.

Jifeng will consider all circumstances and complaints on their individual merits. Jifeng reserves the right not to take action against a customer, even if the complaint is made against the customer for violating this AUP.

Jifeng reserves the right to take technical measures to avoid prohibited activities, if feasible and legally permitted. In addition, Jifeng reserves the right to charge customers for administrative costs related to prohibited activities, including but not limited to the costs of identifying defaulters and removing or interrupting their services, and the amount charged is equal to the actual costs incurred by Jifeng to prevent or respond to the activity.

Nothing in this AUP shall limit Jifeng's legal rights and remedies for any prohibited activities.

This AUP does not affect the terms and conditions applicable to international network services, which are provided by Jifeng within the Jifeng network.

C. Password Protection

The customer is responsible for protecting his/her personal password and for any authorized or unauthorized use of his/her password. Without written authorization, the customer shall not disclose his/her password or use or allow anyone to use the Jifeng service to guess passwords or access other systems or networks. If a network or network equipment is compromised, Jifeng has the full right to assist in the investigation and/or remove the violator at the network level in such procedures as Jifeng deems reasonable.

D. Enforceability and Modification of AUP

If any provision of this AUP or any part thereof is declared invalid for any reason, the conflicting words shall be deemed to be deleted and the other provisions shall continue to remain in full force and effect.

Jifeng reserves the right to update this AUP at any time without notice, and the update shall be effective from the time it is posted on the website https://www.jfwms.com.

E. Applicable Law and Jurisdiction

This policy shall be governed by the laws of the People's Republic of China and the parties shall fully submit to the jurisdiction of the courts of the People's Republic of China.
